do you need to pay back the gross amount inclusive of NI and tax to employer or just net amount? it seems unfair to pay gross amount since you never had the benefit of this.

do employers usually allow you to pay back in instalments?

Does it say anything in the maternity pay policy about how you pay it back? My old firm used to say it was re-payable within 12 months of resignation. I don't know the answer to the tax and NI point - I would assume that you'd pay the net back and your employer would reclaim the tax and NI but that's just a guess.
