Maternity pay confusion

MrsC2810 · 24/02/2015 11:13

I'm currently on Mat leave and due to be back to work in may.
I used to work FT but work can only offer me PT as I can't do my old hours anymore. (6am - 2pm).
my company offer an enhanced mat package which is 13 weeks full pay and 26 weeks 2/3rds pay on top of SMP.
my maternity policy states I have to go back for min 12mths, if not I have to pay back CMP.
I've been trying to work out what id have to pay, would it be the 13 weeks of full pay and the 2/3rds also?

Can anybody help?

you would pay back what is over and above statutory pay which is:

  • 90% of your average weekly earnings (before tax) for the first 6 weeks
  • £138.18 or 90% of your average weekly earnings (whichever is lower) for the next 33 weeks

Although if they aren't offering you a job with similar terms and conditions to the one you had already I don't think you should be paying anything back! Have they offered a redundancy package seeing as they can't offer you a suitable alternative role?

or do you mean you have said you can't do the old hours rather than them changing them?

My boss knows I can't do my old hours so we spoke about part time. I dont think they can/will make me redundant, although it would be nice :)
