I've been with my company nearly a year. Found out I was pregnant and have been signed off by the doctor with sickness. My bf surprised me on Valentine's day with a trip 1 night in Paris and my boss found out. I'm wondering as I'm signed off and wasn't even scheduled to work that weekend if I will get the sack or a disaplenery ? I was very ill over the course of the weekend but my boss thinks I'm taking the micky. I don't wanna lose my job but this has been a very hard pregnancy.

I don't think it is any of their business if you were away when you weren't even due to be in work. How long are you signed off for?

What has your boss said? Has he called you in for an investigation meeting? They would be within their rights to take disciplinary action to be honest. Sorry you're having a crap time with sickness etc but it's a bit silly of your bf to book it and silly of you to go, if you went when you were still signed off sick?

It is their business if OP is signed off work due to sickness. It doesn't matter if it wasn't supposed to be a "working" day.

I doubt that they can actually sack you for it OP - you were signed off as not being fit for work, rather than not being fit for a holiday.

However, if I were your boss, I'm afraid I would think that you were taking the piss too.

Actually it depends on the nature of the work and how the employer found out. If the op has breached any company policies then she could be subject to disciplinary proceedings.

If her usual work involves say, teaching a Y1 class with no TA support, then arguably she cannot do that job while puking every hour. However can she travel on the Eurostar and go to Paris while puking? Well yes, she could.

It depends, so for example if someone had been signed off with a bad back and they were spotted playing football, that wouldn't look too good. Whereas someone signed off with depression going for a walk would be fine iyswim.

In this situation, I'm not sure really, it might be that you employer will get you to see a named doctor and get their opinion.

They could sack you I'm afraid. They could sack on grounds of "breach of trust and confidence". As in, you had stated you were unable to work due to sickness. You can't then have a jolly to Paris, even if you were ill over there. When exactly does your sicknote run out? If it was the Friday and you went to Paris on the Sat then that's ok. Not ok if still signed off.

I was off on long term sick and went on 2 holidays both times I advised my employer. You don't need to be confined to bed and not leave the house. Dependant on your job and what reason your off with though can make a difference.

There's been case law about this and it very much depends on the nature of the activities and whether they are similar to those on prohibited by the fit note.

Is your sickness pregnancy related? It would be risky for them to dismiss you but it would be very unusual for someone to be too unwell to travel to work for the day but feel fine enough to travel to Paris so you can see why your boss is unimpressed. What does your job involve doing?
