Can I be forced back to full time work ?

I have recently changed from full time to part time work - but now my employer has served me with 28 days notice to return back to full time, as they cannot find any one (advertised and interviewed twice..) to fill the other part time vacancy
Can they do this ?

Wow, that's one way to potentially end up with no one to do the job! I have no idea if they are allowed to do this I would assume it would depend on whether you have signed a new employment contract and if do what the T&CS state.

Hope someone more experienced arrives in this thread soon x

I have only been part time for 5 weeks and was awaiting new contact !!....

It sounds as though you are still operating on your full time contract then so I assume that they can renege on their part time offer.

Are you part of a union? Can you go back full time logistically? If you don't have the ability to go back full time and the alternative is that you will have to resign I would be making that clear to your superiors. It sounds as though they have gone a very heavy handed route which may back fire on them.

Was the agreement for you to go part time conditional on recruitment of a job share or similar? Did you go part time as a result of a flexible working request, and if so, how did you propose your job would be done in part time hours, was it on the basis of recruiting someone else?
