Legal advice- my responsibilities being advertised

Hi all

Just wanted some advice really. I am due to go back to work in 3 weeks and logged onto my work email to check a couple of things. I found an emailed job advert advertising my job responsibilities.

Basically, I have been doing a lot more than my 'official' job title (all with the promise that I would be promoted into the full role) and this job advert is for all of the responsibilities above my own that I have been carrying out for the last year before mat leave. I expect that it may well even cover some of my official responsibilities that are down on paper but can't bring myself to read the full job spec as am too upset at the moment.

I have proof that I have been the one carrying out all of the tasks in the job advert but as they aren't in my contract, can I do anything about this in terms of discrimination?

Feels like they are trying to force me out by leaving me with no work to do :(

When you're calmer, I'd email your boss (copy hr/higher boss if you don't like the boss) and ask for a discussion as you saw this and want to know their thinking. You need more information about why they're making the change, may not necessarily be negative. Bad mgmt of them not to discuss/inform you of org changes. No idea of legal side but I think you need formal info from the company about the intent in any case, not just a job spec that looks like yours - could be they're just expanding.

Agree - when you are calmer, call your line manager or HR - would you want to apply for the 'promotion'?

As Gen said, perhaps they are expanding, or your maternity cover has complained about the extra work, or they realised how much you were doing that wasn't covered by your job desc and they have seen a 'hole' in the structure. Your official workload/job desc is still there, so it doesn't seem like they are trying to 'force you out'.

Either way, once you have calmed down, speak to them and find out what the situation is.

Can't apply as short deadline has passed - job advertised with one week to respond and obviously while on ML I don't check my emails every day/week so not allowed to apply.

Contacted work and they deny any overlap, say I could have applied for the job (but knew when advertising it that I would be pretty unlikely to see he advert)

It's a school so not expanding but maybe they have realised how much work I was doing and have now divided into 2 roles. Feel like I should be consulted about this however, esp as the role advertised is paid much more than I received for doing the very same job. Sad
