Additional paternity leave / voluntary redundancy

Amusingly, despite working in HR, I can't find an answer to this!

I'm on mat leave and due to return to work in 4 weeks, at which stage my husband takes additional paternity leave whilst I go on annual leave.

There is a restructure in my company/department, and I have a meeting next week to discuss what my role will be. I'm hugely tempted to take voluntary redundancy and find a new challenge. However, my husband is desperate to have his 8 weeks with our baby, as this is a precious opportunity he doesn't want to miss.

I'll have taken 32 weeks mat leave and with his 8 weeks will take it to 40 in total. Obviously by law I'm entitled to 39 weeks paid.

If I take voluntary redundancy during maternity leave, can my husband still take his 8 weeks APL?

Eligibility criteria for APL. You need to have returned to work.

You and flowery are more expert than me but is there a way, if your company was willing, to negotiate a brief return to work, to work part of the notice period, say, before redundancy kicked in?

I realise this might have tax implications.

Even if I was on leave? Potentially, yes
I've had it confirmed to me today though that I'm wanted in my post so no voluntary redundancy at this stage anyway... Mixed feelings!
