How much do I get paid for accrued holiday while on mat leave?

I'm due to be paid for the holiday I accrued while I've been on mat leave. My entitlement is 30 days plus bank holidays, so 37 days in all.

Do I get paid for the bank holidays too, so for 37 days total?

Also, how is a days' pay calculated? Do they divide my salary by 365 (which doesn't seem fair as i wouldn't work 365 days a year, so the actual 'value' of a day is higher)? Is there a standard way to do this?

Confused as to whether, say, 30 days holiday will be equivalent to roughly one month's normal salary or 6 weeks normal salary (5 day week x 6).

Anyone out there understand how this works?

You don't get bank holidays, you'll had those days off even if counted as mat leave.

A days pay is 20% if your standard working week.
An hours pay is salary divided by 52 and them divided by your weekly hours.

You do get bank holidays, they have to pay them.

Have you asked for the holiday pay or is it automatic? Maybe confirm you're getting it and when with payroll.

Divide your salary by 52 for weekly, then your weekly pay by 5 for daily rate.

You are best speaking to payroll as it will depend on their calculations, they may do like HungryHorace (salary / 52 for a weekly rate, then divide by 5) or some payrolls just do salary by 260 (known working days per year).

You only get paid in lieu of holidays accrued if you are leaving employment, otherwise you have to physically take them.

You accrue all contractual holiday, so if you normally have to take x numbers of paid holidays on bank holidays, you don't lose them just because you were on mat leave at the time.

Most employers calculate a days pay as 1/260 of annual salary for full time staff, but your payroll will be able to advise you how they do it.

My figures are the same using both methods...Spider's is quicker though! :-)

Oh great - so 30 days IS six weeks pay, then. Was hoping so!

I know the bank hols thing is a bit confused. In my job, the working week was Tues to Sat so we always got Monday bank hols as a day in lieu. Likewise, any other bank hols eg Good Friday, Christmas Day, were classed as normal working days (as the office doesn't close) so again if worked it'd be a day in lieu. Does that change things?

And yes I am leaving employment, sadly, as my flexible working request was rejected...

I've looked up the bank holiday rule and apparently an employer can treat these differently, you'll need to speak to your employer and not just assume you'll be paid.

There's no specific "bank holiday rule". Employees are entitled to accrue contractual paid holiday throughout maternity leave, and are entitled to all contractually benefits just as if they were at work. Bank holidays are not an exception to this requirement.

If they are contractually entitled to a days paid leave on bank holidays, it is unlawful discrimination to deny them that paid leave because they happen to be on maternity leave at the time they would normally take that particular day, as that would be treating them less favourably because of their maternity leave.

Your holiday pay would be the same as if you were in work, so a days pay, by the sounds of it you work a standard week with 30 days annual leave so should be standard for your payroll to calculate.

Bank holiday pay differs in organisations, in ours we pay for those bank holidays that took place while the employee was on maternity leave, so 8 if they took a full year and less dependent on the time they were off and which bank holidays took place. These are then added to the annual leave.

In terms of taking leave, legally I believe you are supposed to physically take them, but while you're on maternity you could argue that you are taking them!

You cannot be paid for your annual leave whilst receiving maternity pay, it can only be paid during your non maternity pay months, ie the last three!

I asked for my accrued leave to be spread out over the last three months so I was reviewing 9.5 days pay for the last three months so these were not unpaid. Another way is to say to your employer I want to come back to work on say 1st April but then take my accrued leave and actually return to work on 1st may - this is an option if your employer does not like the idea of paying holidays in any other fashion! Hope that makes sense?!?
