Not entitled to SSP

I work part time and earn 121 a week. I had an operation which meant I was off work for 5 weeks. I thought I would get SSP but my employer says not because I actually only was paid an average of 99 a week in November and December due to childcare problems and sickness.

My employer says I can get SSP from the Jobcentre but when I look on their site it says it takes my partners wage into account when weighing up if I'm entitled so it doesn't look like I'll get anything.

Does this sound right? I'm in no position to be short this month but I can't see that I will get any help. :(

It would be ESA not SSP that you can apply for. Do you pay national insurance on your salary? If so you may be able to claim contributions based ESA, if not and your partner is working then its unlikely you would get anything, sorry.

No I don't earn enough to pay NI and my dh works.

Looks like I'm stuffed. :(
