Today is pay day...

its 5.55pm and my colleague's and I still havent been paid.

Pay day as per our contracts is the 23rd of each month.
For the last 5 or 6 months prehaps more, our wages are not being paid into our accounts until well after close of business

I would welcome suggestions on how to bring this up with the owner, She is not easy to talk to, she is very good at talking over you and making you seem unreasonable.

Our manager, talks the talk, wont call up and ask if theres a problem.

It's Sunday. Of course money paid in isn't going to show up today.

I'd have thought you shoukd have actually been paid on Friday? I've never known wages to go in on a Saturday or Sunday.

My pay day is 23rd also but if it falls on a weekend we get paid the previous Friday. Perhaps yours is just the next working day.

As long it's paid before midnight on the due date I don't see a problem.

When my pay day falls on a weekend I get paid on the Working day before. That's terrible - does she have cash flow problems or is she just disorganised?
Either way perhaps you should be looking for another job where the staff aren't taken for granted.
I'm sure unpaid wages are grounds to issue some kind of insolvency action on the business - perhaps someone more knowledgeable will be along soon.

It wouldn't go in on a Sunday not if she's using bacs. It would be tomorrow. Although it would usually go in on the working day before so Friday.

Does it clear in to your bank by midnight on the 23rd? So arriving on the due date?
We task up our BACS payments several days in advance for payroll so it does run at funny hours of the day or night. It always arrives on the correct day, but often not in 'business hours'.

we're paid by bacs yes.

So we could have been paid but it wont show then,
Until tommorrow?

If she paid over the weekend, will it show first thing tommorow I wonder.

I havent been there as long as most of my colleagues, apparently when it used to fall on a weekend she used to pay them on the Friday, it would seem as her business has grown, her staff do not seem to matter as much.
will dig my contract out and see what it says.

I think it's standard practice that if payday is during a weekend, you get paid the Friday before - but I have no idea if that's just good practice or an actual requirement. Having a look at the wording of the contract is a good idea.

DH gets paid the next working day if pay day falls on a weekend or bank holiday.

And that's with an enormous multi national company.

It is normal to get paid the Friday before, but it isn't always the case.

So you have been paid on the correct day always, just in the evening rather than during the day?

I think it's a gigantic leap to assume "her staff don't matter as much" because you're being paid a few hours later than previously tbh.

I know very little about bacs, and how it works. How is it that 2 transactions by debit card yesterday, show up as being made on the 24th (tomorrow) on my mobile phone app?
Yet it wont show money being paid in, apologies for being a bit thick here.

because if you think about it logically, all outgoing money has to leave people's accounts first otherwise where is the incoming money going to come from?

I know that's oversimplified, but that's the gist of it. ie if A is paying money to B, B is paying money to C and C is paying money to A, theoretically A has to pay the outgoing payment first, otherwise none of the others can happen.

A pre-arranged BACS payment should be in your account at start of business on the payment day. At weekends, it might vary by bank, but online I can see my Monday's transactions on Saturday morning. The BACS file is usually prepared in advance and transmitted a few days before the payment due date.

AFAIK only a payment that is manually triggered can arrive after close of business; for example if you do a Fastpay after the day's takings have been paid in (which would suggest teetering on the edge of a cashflow crisis)

If you had direct debits and standing orders on your own account, due to go out on 23rd, they would also go out by start of business.

Its been put in at random times on the 23rd of each month.

There are other issues as well nothing to do with payday, my colleagues are not very happy with a lot of things that have happened over the last 6 months or so.

like I said previously, I have only been there a short space of time compared to them.
I can only tell you what Ive seen and heard in that time.

I posted for advice on how to approach the 'issue' with her.
I will find my contract and see what it says on there.

But if you've been paid on the 23rd every month until today, and that's because today's a Sunday, then I can't really see any justification for approaching it with her tbh. You could ask for clarification on whether payment would normally be the preceding Friday or following Monday if the 23rd is a weekend day I guess but that's about it.

Your contract won't specify what time of day payment will be made, and if it's drafted by anyone decent it probably won't absolutely guarantee a day either, it will say "usually", or "on or about" the 23rd.

There may well be other issues that need raising but I'm not sure getting paid the first working day after normal payday is going to add much to any overall picture of problems you may be building up to be honest.

Adding in things like that can risk detracting from genuine issues, making it look like an employee is just looking for mud to throw rather than having any real cause for complaint.

Some banks show it at the weekend for Monday morning , mine doesn't .
If the day falls on a Saturday we are paid on the Friday, if a Sunday we are paid on the Monday.

You can't go on like this, you have to take it up with her. Do you have a union or is it a very small company? I was under the impression that if you are due to be paid on a certain date and the date it a non working day I.e. Weekend/bank holiday, they had to pay you early. That has always been the case in every job I have been in. Call CAB if no luck.

Weekends are not bank working days however some transactions will show as provisional enteries. Today you will be able to see the confirmed enteries for fri, sat and sun. Does it show now as being paid on the 23?

Tbh I'm not sure I understand the issue with what time of day it goes in, does that matter?

Yes small buisness, 5 settings with at least 3 people per setting due to adult - child ratios.
We have 5 members of staff, 1 of whom is only there 3 & a half sessions a week.

Flowery - my contract states
quote "this is paid monthly on the 23rd of the calender month" unquote, nothing else at all.

So taking into account what a pp mentioned should I have reasonably have expected it to be there this morning? It isnt, Ive checked.

Apart from your contract, do you have a staff handbook? This would normally contain more detail than the contract, such as if the 23rd falls on a weekend when you will be paid.

I once didn't get paid due to the bank not processing one batch of BACS instructions issued by my employer, but we were warned by email that we might be affected and were told any charges would be covered.

No, no staff hand book given to me when I started, although reading my contract iust now, it does says I should have been given one.
I believe our manager has a copy will have a quick look before I start work.

Cant you just ask her? Say/ email "Hi X, I havent been paid yet for this month. Aware the date might be different as 23rd was a Sunday. Can you tell me know when the salaries will clear as I need to make a couple of payments"

The banks isn't open on a Sunday to clear the funding! Hence working days and the like! If wages aren't clear today then you need to ring her!

I've never known anybody to be paid on a Sunday, sometimes a Saturday yes but never a Sunday!!

Ask your colleagues what happened when payday fell on a Sunday previous !
