I have been on maternity around 5 months now my boss refused to pay my maternity so I am receiving maternity from the social... Do I have to go back to work?

No of course not. You will need to give your employers the required amount of notice though if you are not returning to work.

Thankyou would I need to pay the social back I'm new to all this so don't really have a clue

Was it SMP you have been claiming or Maternity Allowance? Either way I'm pretty sure you won't have to pay anything back. It is only if your company has paid you an enhanced maternity pay package that you may have to pay some back but it doesn't sound like you employers paid anything towards your maternity pay, so you won't need to pay anything back.

No my employer hasn't paid me a penny I worked for them for 6 years..... And am just receiving maternity allowance from the social.... Would I have to write my notice to them?
