additional paternity leave question

Hi

I am on maternity leave, and am due to go back on 24 feb after my 39 weeks is up.

My DH would like to take APL and I am confused about two things:

1. He doesn't want to be paid. Do I have to go back at 37 weeks? Or as he does not want my SMP can his leave start directly after my 39 weeks?

1. My baby is not 12 months til August. Can he take APL til my baby's first birthday or for 26 weeks ( whichever is sooner) or does it stop 52 weeks after I started my stat mat leave?

I have read all the guidance and thought I was clear, but some threads on the subject have confused me.
