Trying to work out if DH & his colleagues are being diddled out of holiday...

So, DH gets 28 days holiday-he can book 26 of them anytime and 2 have to be taken over Christmas. Most Bank Holidays are classed as normal working days so he works them and they are not included in the holiday entitlement.

He will be working Boxing Day & New Years Day for which he will be paid double time plus 2 days off in lieu.

However, his company have said that the lieu days will have to be taken on Christmas Eve & New Years Eve to cover B'Day & NY Day (which also happen to be the 2 enforced holidays).

It looks like the lieu days are being used to make up the 28 day entitlement and he isn't getting lieu days at all.

Does this sound right? I'm confused just writing it down... Xmas Confused

It sounds right to me, lieu days aren't extra, he still only gets 28 days.

I think you might be right OP if the deal is that he gets extra pay and TOIL for working those 2 particular days, so in other words he gets double time and 2 extra days. It would seem quite generous though, are you sure he's got that right?

If everyone else is being forced to take those two days as part of their entitlement, I expect that's what they mean by in lieu, as in they will take them at another time, ie Christmas Eve and New Years Eve.

Double pay and additional holiday would be extremely generous and unusual really, particularly if he works bank holidays regularly. Does his contract/policy set out what happens if people work on bank holidays over Christmas?

Thanks all - I see what you mean about still getting the 28 days.

I think the confusion has arisen due to the way the company "sell" the bank holiday deal to the staff. i.e you get double pay and extra days when really they are not.

He works every bank holiday but the 2 Christmas ones are the only ones which have this pay/lieu day deal.

He needs to dig his contract out - we have this conversation every year Grin
