Question about holiday pay and TOIL

My DSis has been in her job for 7 years and they have recently had a new head of department. Suffice to say, this person is horrible. My DSis, who is very, very good at her job is finding herself being undermined, undervalued and constantly criticised and as a result her confidence is shot. From what I can gather, this person doesn't actually do or say anything illegal, but the relentless criticism, being made to look stupid, undermining and so on has meant that my DSis has had enough.

I've never known my DSis like this, and I've found myself getting really angry on her behalf. As a manager myself, some of the things this person does and says make my blood boil.

If she wanted to follow it up she may have a case for bullying - but I don't think she wants to go there, she just wants out. She's owed quite a lot of leave and TOIL and is keen to know whether she can insist on taking the time, rather than being paid for it?

Has she spoken to her manager about this yet, or HR? I don't think it's ever wise to just retreat and walk away in these situations without trying to solve the problems first. Surely just handing your notice in is a last resort?

Whether she can insist on taking the holiday/TOIL rather than having it paid out will depend entirely on the employer's relevant policies. I would doubt it.

Ah well, it's all academic now. She's handing her notice in tomorrow. Merel, she has tried on several occasions but it looks like she just doesn't like DSis. In fairness she appears to treat all the staff like dirt - but saves her choicest venom for my DSis.
