I have to do a witness statement for an equal pay/sex discrimination case. At the CMD the judge asked for gender statistics from respondent by certain date and I had to state if adverse disparate impact. When I got them, it showed significant differential so I claimed adverse disparate impact on women. Now respondent saying those figures were wrong and new figures show greatly reduced differential?? Where do I stand now that Respondent has changed the figures after the court deadline - this seems ridiculous! Do I need to challenge this or do I simply have to accept it? Have been told by a solicitor initial appointment I have strong case for sex discrimination /equal pay so should I just focus on that and not worry about adverse disparate impact?
