My team was TUPE'd across to another employer in Jan 2012. I am now in a position where I may have to be signed off on sick leave (not sure how long for). My new company provides 13 weeks on full pay (I have been in the job 5.5 yrs and not had a day off sick) but my old contract was only 8 weeks. I don't have a full new contract but the letter says that there would be no change to my company sick leave entitlement :-(

I had some vague memory that new t&c's had to be at least as good as old ones but that where new conditions were better then these would apply? Or am I mistaken? It's not really a question I want to put to HR yet.

You stay on your previous t&cs, you don't get the best elements of both.

We have a lot of TUPE people in the team I am working in. It is a common misunderstanding that you can pick and choose the terms. For example the tuped people for the same grade are paid on average of 15-20% more than the company they have tuped into. They often forget this and talk about the extra 1 week the receiving company gives to their employees!

We work at home often so actually having to take holiday for say workmen to come around isnt really necessary.
