Daughters Apprenticeship Issues can anyone help?

My DD began an apprenticeship at a Nursery, (Large company) in April 2012 she thought she was signing up for a Cache level 3 and it turns out that, not only is it a level 2 ( neither use nor ornament for future jobs) but even though she was working there from April 2012 on £2.60/hour her official training did not start until November 2012. She has now completed level 2 and they are ending her contract on june 30th and not offering her a level 3 even though they promised they would last year. She has absolutely worked her socks off for that nursery and has the most glowing references from her room manager and nursery manager but head office say no she cannot have another apprenticeship. I think this may be because she will be 19 at the end of the year and they wil have to start paying her £4.98/hour because they are already advertising for a new apprentice on the website before she has even gone anywhere. My question is, can they do this to her and if so should she be entititled to NMW for the work she did from April to November when she eventually got assigned a tutor and a college to do her official training. I cannot let this go, even though she will get another job somewhere else, she is brilliant and her refrences are so good, I feel these people are playing the system and my DD has suffered because of it.

In your situation I would be straight onto the Citizens advice Beaueau. It sounds like they have misled DD badly. Angry And you might be able to take them to an industrial tribunal.

Did she actually have an apprenticeship from April 2012? Does she have an apprenticeship agreement?

She started in April 2012 and so is now 13 months in to her contract with another month to go? Ok well you can only pay an apprenticeship wage for 12 months - so she should be on NMW now. Is she doing any college based learning? Do they have student union type officers who could help her?

Tell her to call Voice. Even if she not a member they may be able to give her some advice.

Does she have proof they offered her a l3 initially?

She has no concrete proof some of her stuff says level 3 some level 2 but she does have the commencements agreement for a level 2 dated 25/09/12 so all of those hours she worked before that date were as a non apprentice, if she gets a new job I am going to encourage her to take them to a tribunal to get what she is owed in wages from april 2012 to September 2012 if nothing else I calculate that at about £2400 she has been done out of. I am absolutely livid about how she has been treated but she is so laid back she is just accepting everything they say as gospel and I really want to ring them up and give them a right mouthful, but where will that get her. They are giving her an interview tomorrow for a job that does not exist, they said they will then give her some bank work and keep her name on file for any future positions, oh god I am so livid.Angry
