Bank Holidays during maternity leave

Apologies as I know this has been asked before but I've only found old-ish threads so would appreciate the current consensus... if there is one!

I work part-time so my annual leave is pro-rated: I work for 2 days per wk so it is 0.4x20 days plus 0.4 x 8 days for the Bank Holidays.

I've just returned to work and HR have told me that days from my holiday entitlement have been used for bank hols that fell while I was away. One of my working days is Monday so this is quite a few! Is this correct - surely on those days I was on maternity leave, not using annual leave? Does it make a difference whether it was statutory or ordinary mat leave?

Surely all throughout ML you are accruing holidays, no idea why you would be using any. Unless you agreed to return to work early, and use all your holidays up in final month (as I have done) but don't think that's what you're saying.
They are saying that as you had 4.8 bank holiday days "off" that you aren't entitled too, they need to use some of your holidays for that. But this doesn't sound right at all, you were on leave throughout that time - I really hope someone who knows the answer comes along as I'd love to know too!
