Part time and bank hols entitlement

I have returned from mat leave working 2 days a week as part of a job share. I work Mondays and Tuesdays. On returning I was told that I would have to take all bank holidays as annual leave, whereas the lady I job share with (who works weds-fri) gets given all the bank holidays back and added to her holiday entitlement!!

For staff who work full time, they receive 28 days holiday a year and don't have to use annual leave for bank holidays.

I am therefore in a position where about 6 of my 11 days annual leave have to be used on bank holidays - not great when you also have a Childminder taking 4 weeks holiday a year!

Are they treating me fairly and is this right?

At my work they pro rata all bank holidays. There are 8 I think, I work half a week and get 4 days added to annual leave. I work the scond half of the week so normally only have to book good fri and maybe christmas so often have extra days to use. For people who work mondays they use annual leave too- or have the option to work another day that week. This is the fairest way I think. Are you sure you've understood correctly how it works? It would seem odd if one part timer is given bank holiday days (taken whenever) and the other not?

I work a job share 50:50 and we both have to use annual leave for bank holidays.

I get pro rata bank hols as well as holiday.
I work a 3 day week. Company holiday is 5 weeks. I get 5 weeks as I only have to take my days off. But it's 15 days officially.

I get 3/5 of bank hols which is 8 a year so I get 5. These are added to my holiday allowance. I have to then cross out bank hols that fall on my days from this.

Some years i do better than others depending on Xmas.

From CAB website here apparently they can make you take it from your holiday entitlement. I work part-time on a monday and I get them as a public holiday and don't need to make up any time.

I think you should be entitled to more annual leave. You should get 3/5 of the total bank holidays (think its 8 is it?) so your allowance would be 16 for the year, of which you will have to use 6 for bank holidays.
Thats the way my employer does it. Otherwise they would be discriminating against part time workers, as full time workers get their annual allowance plus 8 bank holidays

All p/t workers get a pro-rated bank hols entitlement - regardless of which days they actually work.

Therefore you'll get a two fifths entitlement and your colleague who works 3 days will get a three fifths entitlement.

As most bank hols fall on a Monday, if a Monday is part of your normal work pattern then yes you are going to notice it. Wish i'd known about this when deciding what days to work (I work on Mondays too so I feel your pain!)

Spoon - afaik, this would only be fair if the employer applied this policy to fulltime workers as well. They can't have one policy for fulltime and another for parttime

In my last job full timers got bank hols on top of annual leave. For part timers you got either paid in lieu extra if you didn't work Mondays or a pro rata deduction from salary once a year if you did work Mondays, plus the time off. They did the calculations and made the alteration to pay once a year, the exact sum also factored in whether you worked Fridays and varied according to what day Christmas fell on. So annual leave was not affected, it was all done through salary.

Oops - you should get 2/5, not 3/5 (I was thinking about my own entitlement) so should be 14 days not 16

Possibly my HR dept arent the best, i confirmed about the bank holildays when I started as I assumed i would need to take it as holiday or make the time off but they said no and I am sure it is my contract as well.

Yes my contract says - in addition you are entitled to take the usual public holidays in England and Wales. You will be paid your normal basic remuneration during such holidays.
