Trial Periods

Hi All,

Really appreciate any advice, in short my partner is at risk of redundancy. He has applied from one of the remaining positions at the company.

Firstly, he has been told it is not an alternative role. Can this possibly be correct?

Secondly, if he takes the role (has been offered) it is at a lower salary. Will he get a trial period? Again he has been told there is no trial period...

Finally - assuming I am right that this is to be considered an alternative role, and therefore involves a trial period, if he or the company terminate within the trial period, and he gets redundancy (he is entitled) will it be at the old rate or new rate?

oh, sorry, one more - ex gratia payments are entirely at company discretion, therefore assuming he would be entitled to a payment following redundancy (if failed the trial) there is not guarentee that the company would offer the ex gratia payment they are currently offering.

I can't answer all your questions but I do know when we held redundancy meetings and offered a different position to employees they were told they had 6 weeks in the new role to change their mind and accept redundancy.
