Accrued holiday whilst on ML

I'm returning to work on a part time basis, 4 days a week when I was previously full time.

My company are paying me for accrued holiday and bank holiday up to the end of August. I return to work in September.

Does anyone know if I should be paid this as if I was still full time or if they can pro rata it to my part time entitlement?

Surely you accrue holiday at the full time rate as you were still full time until your return at which point your contracted hours will change? Sure someone more knowledgable will be along soon!

When I returned part time after having my daughter I accrued as full time for the proportion I was on mat leave and for rest of year was at my part time rate. So April - oct was full time then oct - mar part time. You at full time until you start working as part time so I would assume similar

Thanks. That's what I assumed but my company are saying different. They've calculated it as statutory leave rather than normal contracted leave and then pro rated the statutory leave for part time hours.

I can't find anything on the direct gov site relating to change of hours and holiday pay.

If you decided not to return to work at all , the accrued holiday would still be paid at the rate you worked during the time you got your entitlement to maternity leave.
Will you get a new part time contract when you return? Until then, you're still full time surely?

I was paid full time holidays while on maternity leave then part time holidays when I went back part time. Our HR had never had to deal with pregnancy related issues before and had to go away and read up about it.

You have ML on the conditions you left ie: full time. When you return to work (albeit even if you take annual leave and do not step foot actually at work) you and HR agree your new hours and you can take your accrued annual leave "part time". That's how my work does it anyway, and I work for the government so I guess it's right !

Thanks Jareth. The site doesn't explain it clearly enough for me to argue with my work that my holiday should be on a full time basis.

bike sorry if I'm being an idiot but what did you mean by take your accrued leave on a part time basis?

When your part time hours were agreed you should have had a letter amending your contact and giving an effective date for the change. Check the letter, and holiday is accrued at full time rate up to that date.
