Working contracted hours but taking an extra day off

I've posted about DHs work before because I really think he is being taken for a mug but anyway .

So he is contracted to work a "minimum of 45 hours per week" and he usually does 5 12-14hr shifts per week . So next week he will only be working 4 days as we have a wedding away . But he will still be doing at least 48 hours over those 4 days .

So legally can they take a days annual leave off him for the extra day off ?

I should add he gets the same salary no matter how many hours over the 45 he works .

Well he is taking a day off, and working less hours than normal as a result, so yes. The fact that he is working very long hours generally is a separate issue I think. Obviously ideally they would allow him to accrue time off in lieu for extra hours worked and use that up, but he can't force that.

Has he contracted out of the Working Time Regs?

If he's salaried and he's contracted to work that day, then yes, probably. It is petty, though.
