HOLIDAY ENTITLEMENT AND REDUNDANCY QUESTION - IF MY NOTICE EXPIRES PART WAY THROUGH THE YEAR ?

I have been given my redundancy notice and am leaving mid September.

I work part time. I have 18 days holiday entitlement this year (including Bank hols) which runs from January to December.

I will have used 14 days up to when I go in September.

I therefore have 4 days left.

Could I use these 4 days to allow me to leave my job a bit earlier ; or

Is my holiday entitlement pro-rated as I am leaving in September and I would be penalised financially if I took that holiday and would effectively have to "pay them back " ?

If that's the case, what if, at the time I was made redundant I had taken all my annual leave ?

I've had a look round the internet but can't find the answer.....so if you know the answer and can help, thanks !

If you're leaving part way through a holiday year then you are only entitled to pro rated hols.

Eg if leave year is April to March and you get 28 days, then you're entitled to 14 days to the end of September.

Sorry. Put more simply you divide number of days by 12 then multiply by 9 (Jan-Sept) to get this years' entitlement = 13.5 . looks like you owe them half a day, which they may or may not dock from your final pay/ settlement.

It depends what your contract says. However, general practise when someone leaves part way through the year is that they are only entitled to part of their holiday. On the figures you have given you may find that they will deduct something from your final pay even if you don't take any more days off as you have already used more than your entitlement for 8.5 months.

Cross posted with hairytale. But I think you may owe them more than half a day. If you are leaving mid-September you have only completed 8.5 months, so you may owe them 1.25 days.

Thanks for those responses.....I think now I understand the concept that I might owe them. I did e-mail someone earlier to find out and she seemed to think that I wouldn't owe them but on the other hand have nothing left to take.....Maybe they have called it quits !
