Gross Misconduct/ Constructive Dismissal

tI have just had a very tough day at work. I am becoming more and more convinced they are trying to get rid of us, ie everyone with my job title.

I am the only wage earner atm so can't quit until our job hunting succeeds and so far it has been a disaster with no interviews. I am stressed out and terrified they manage to construct a gross dismissal case in the mean time. Six months of zero income will cause us to lose everything and we won't be able to feed the DC.

They have promised zero compulsory redundancies. The big boss hates us and tells anyone who'll listen that all are idiots and useless. They ask us to do the impossible eg today they didn't want me to speak but a big part of my job is answering the phone so either way I was in trouble. They change the criteria we are marked against then don't tell us. They change our rota then hold off telling us til the last minute.. When I said I was coming back from Mat leave they said I was 'making it difficult' for them and asked me to wor

Do you have a partner who could work?
It sounds as if your role has become a bit in question I mean do the phones not ring anymore so they are querying you answering them?

DH has already been made redundant. Neither of us can get interviews. The phones still ring. Answered it 43 times today.

What sort of role do you have? When the boss says your lot are useless what are the others doing that is somuch better? Is the firm in trouble overall?

Don't want to out myself there are only 5 of us. I could just about cope with redundancy as then at least we'd have JSA to help while we continue to job hunt. That makes me sound horrible doesn't it:(

Jsa is only £70 a week (single person)

I know but if they manufacture a gross misconduct dismissal our family income will be zero until we get some success in our job hunting. I have managed in the past 3 months to get 34 rejections, the rest of my applucations haven't even earned me a reply. I'm feeling really desperate.

Gross misconduct is different and they would face a tribunal if they manufactured one . I thought GM was things like dishonesty fighting at work.
If they are saying you are useless then this is a capability issue
If the whole team are no good then this means they have recruited unwisely which makes them look stupid really
If they are saying there is no work for the team anymore this is redundancy

The thing is they say we are useless because we speak instead of working in silence but our job involves answering phones (not the whole part of our job) so we can't do both. They say we are shit because each of us have less than 20 years experience yet I am the oldest and 20 years ago I was only 15. Do you see where I am coming from?

I have met every performance indicator they have set so far which is why they keep changing them as they get quite annoyed at us meeting them. The point is I'm not useless they are trying to manipulate the figures to make us look as if we are. The big boss hates everyone that has the degree we have for reasons only known to her.

It would be incredibly difficult to manufacture evidence for a gross misconduct dismissal and would be a very strange thing for them to attempt to do. They'd have to plant evidence that you'd been stealing or something. They might be trying to make things unpleasant in the hope that people leave, that's possible, but inventing a gross misconduct dismissal from nothing at all would be an incredibly bizarre thing to try and do.
