Technical question for someone in HR - I've been made redundant: Paid in lieu of notice but no pension contributions in lieu of notice

I was recently made redundant.

I have been paid 3 months in lieu of notice but noticed I have not been given 3 extra pension contibutions by my company (which I would have done if i'd worked my notice). Can they do this? I asked HR this question from the day they gave me my first "at risk" letter but of course they just ignored me and i never got an answer.....

Would really appreciate some help!! Thanks!

What does your contract say about payment in lieu of notice?

Usually if they are contractually entitled to terminate immediately and PILON that means salary only, not benefits. If there is no contractual right for the employer to PILON that means such payment is effectively compensation for losses incurred as a result of not being able to work notice, which would usually mean an amount including benefits that would have been received.

god flowery - you are totally right to pull me up on that! I have been so manic trying to sort out interviews, tax, expenses etc that I haven't been back on mumsnet to thank you. Really sorry and i do appreciate you spending the time replying. I have to locate my contract and check. My company was a big MNC so I guess they'd not be being illegal except for the fact they made me redundant cause i was part time which i am pretty sure is illegal Hmm
