Who do I complain to when AWR have been breached?

I worked for a company through an agency and when I reached 12 weeks my pay was not increased to match the permanent members of staff.
They did identicle roles and they were on a lot more money.

As I understand it as of oct 2011 if an agency worker has worked for a company for 12 weeks they are entitled to the same rate of pay.

My agency were not very co-operative when I asked them for advice. (I think they want to keep the company on side and don't want to help me if it loses them the contract)

Can somebody who has experience on this tell me if I am right and what to do if I am.

The agency is your first port of call for a complaint, which should be in writing. They must respond within 28 days and should make sure they've requested pay information from the end user employer.

If you don't get anywhere you can bring a tribunal claim against the agency. If the employer has given the agency misleading information about pay rates you may have a claim against them as well.
