Bank holiday entitlement

Hi, can anyone help please?

I'm currently in talks with my employer about going back to work and they have advised me if my holiday entitlement which does not include the 8 bank holidays I have missed. Should these be added to my holiday entitlement?

It depends on whether bank holidays count towards your statutory holiday entitlement or whether you get them on top of your holiday. IOW, do you get 28 days plus bank holidays as well, or 28 days once bank holidays are included?

If it's the former, then your employer doesn't have to give you holiday in lieu of missed bank holidays. If it's the latter, then they do as those days counted towards your statutory entitlement.

Thank you for that, makes much more sense now :0). I get holiday plus bank holiday so guess I wouldn't be entitled! Oh well, was worth a go!! Lol.
