Calculating holidays within term time working

Hey all. I'm new to Mumsnet so sori if I'm not with the lingo/acronyms! I have a query about holiday entitlement.

I work 28 hours term time. That's 39 weeks in the year that I work. I get 4 weeks paid holiday plus 40 weeks' pay pro rata'd across the year (not sure why 40 weeks, but that's what it is) so paid for 44 weeks of annual salary which is £12,000.

No other term time workers but other f/t & p/t staff get 22 days plus Bank Hols, plus Jubilee Holiday this year plus extra days when the office is closed at boss's discretion - these vary but are normally around 8 extra days in the year, which happen to fall within the school holidays when I am off.

Is my annual leave entitlement calculated correctly and/or how should I be calculating it? I get the feeling I am missing out here - am I and would I be entitled to any kind of back-payment? Any help you can give me is really appreciated. Have called ACAS but they've confused me more!! Hope someone can help with this headache!

Slightly different because I work in a school rather than for an outside employer, however: Are you sure your paid time does not include payment for bank holidays when you would normally be in work? You say you actually get paid an extra week so I would check to see if this is your 'share' of the bank holidays. When I used to work four days, I discovered that because I was not contracted to work on Mondays, I did not get pay or TOIL for any bank holidays that fell outside of my contracted hours. whereas colleagues who had Tuesdays off, did!

I suspect that most of your problem is that a lot of these days 'off' fall on days for which you are not normally paid ie: in school holidays. So you feel as though you are losing out when the likelihood is, you are not.

FWIW, because the Jubilee Bank Holiday falls within half term this year, we are not getting the extra day, just our normal half term ( they have even moved half term week purely so that we only have the same number of days off as in a regular year) DISCLAIMER: Not complaining , just saying,.

Thanks for your msg. - fear you might be right. ACAS said though there are 8 bank holidays a year so maybe my bosses still owe me for 3, if 5 have been calculated into my leave already. ACAS seemed to think that if the other f/t & p/t staff got additional time off at the discretion of directorate, then I might also be entitled to that time too to be taken in lieu as otherwise it appears they might be discrimminating against me just because I am term time. Thanks though, I really appreciate your response. :)
