Returning after mat leave query

My friend has requested part time work (4 days) when she returns. This has been rejected and rejected at appeal, however she has been told if she resigns as head if faculty they will allow 4 days?

Is this legal? Anything she can do?

They are basically saying her current role is not suitable for a p/t role and offering her a different role which is suitable for p/t hours? Yes, as long as the reasons fall within the permissible business reasons for refusal, perfectly legal.

She now has a choice - return to the old role (which is her right) on the hours she left it, or take the new role on the hours she wants.
