Asking for a friend who isn't involved with MN but listens To me raving about it too much
Friend works for a care agency.
Care agency is starting to lose contracts from social services and private clients. There is talk that they are struggling financially.
The last few months may of the girls have noticed inconsistencies with their wages. Incorrect amounts, wrong fuel amounts, changes to contracts without informing the staff.
In Feb, friend was put on guaranteed hours of 30 a week. As long as she was available for at least this amount she would be paid this amount, it was the companies responsibility to fill those hours. Friend signed a contract that stated that a review would only happen after 3 months if the 30 hours were not being fulfilled by either side. Friend signed and sent back, she has a copy.
In March friend recieved a payslip and was short about £200 pounds, after investigation it appeared that the payroll dept had decided not pay any guaranteed hours as no one had fulfilled them, despite being available. Friend had been caring with this company full time, sometimes working 3 out of 4 weekends, week days and evening. She moved to guaranteed hours after being assured it was tw beat way to go when working agency style.
Mid March my friend handed in her notice after being offered a better job in a better company. Friend emailed boss with a very lovely letter of resignation and also asked of she could receive in writing if it states anywhere in the contract that the employer can withdraw guaranteed hours conditions without notice. She received a very non committal answer.
Friend was told in writing that she would recieve final pay today, which included
Holiday fund (which employees pay a % of their wages too every month) it turns out she hasn't recieved it all as the admin dept didn't inform payroll in time so she wasn't classed as a leaver!! So final pay will be 23 May! they still haven't fulfilled guaranteed hours again this month despite leaving she was still entitled to this pay.
She's gutted and a bit lost now, hence the post.And has the following questions:
- can an employer change terms
And conditions of a contract without informing employee?
- what can she do to fight it? Can she fight it now she's gone?
- can an employer withhold final pay due to an admin error on their part?
