My company has paid for me to go on training. I have had to sign a contract which says I have to pay back;
100% if I leave within a year of completing the course
50% if I leave after one year but under two years of completing the course and
Nothing if I leave after two years.

My question is: if I go on maternity leave (for one year) immediately after completing the course and then resign as soon as the maternity leave is over, do I have to pay back 100% or 50% I.e is maternity leave still classed as employment in this case?

Yes, it would count as employment, so you would pay back 100%

Hi, if it counts as employment, wouldn't that mean I only pay back 50% since it would be over a year since I completed the training?

50% based on info given.

You use If I went on maternity leave.... are you pregnant now? when's the course? if you'er not then it's only a few months to hold out to fall into the two year bracket.

I'd check your maternity leave policy aswell just incase enhanced maternity pay needs to be paid back too.
