Holiday pay & tax whilst on ML query

I don't know if anyone has any thoughts on this....

My contract at work does not really state either way but I thought that generally you still accrued your holidays whilst you were on ML and that you could then tag them on to the end of your leave (if you wanted).

I get 20 days holiday per year and we do not need to actually accrue the days before we take a holiday. So, for example I could take 2 weeks holiday in February but I would not actually have accrued them as our holiday year runs Jan-Dec.

My questions are this:-

  1. My most recent wage slip says I have been paid for my holidays and work have not mentioned this at all and now I have been taxed. Is this usual?
  1. I am also confused as to why my SMP is more in January too? It has gone from £514.92 to £643.65.
  1. Another confusing thing is that it is 4.5 days they have paid me for, if anything I would have expected it to be 5 days.
  1. Can I claim the tax back?

Holiday pay and SMP are both taxable income.

You do accrue holiday throughout maternity leave, but it's not necessarily up to you when you take it.

Holiday must actually be taken- you can't be paid in lieu.

I'd suggest contacting payroll and asking them about the variation in SMP, and contacting your manager to say that you seem to have received something called 'holiday pay' but have not booked or taken any holiday.

Probably because it was a 5 week month & mat pay is worked out as a weekly rate.

The holidays it turns out were what was left from last year, seems odd as I asked what holiday I had left before I went on ML and I used it up but hey ho, who am I to question extra hols :)
