Maternity leave coinciding exactly with holiday year - what happens about accrued holiday?

My due date is 2 weeks into my holiday year. Obviously the baby may be born before then, but currently I am planning to take the first 2 weeks of the holiday year as holiday, and start ML on my due date. I would like to take a year off, during which I will accrue 3 more weeks of holiday. I understand normally holiday has to be taken within the holiday year. Should my employer let me, in this circumstance, carry the holiday over, or can they say I can't (in which case I would finish my maternity leave early so as to be able to take the holiday, which will be paid, within the holiday year). I would rather have the extra days than the money, I think.

They should allow you to carry it over or pay you the equivalent. I did a mix for ds1, and used 2/3 as leave and got the remainder in my first paycheque when back at work. The extra cash came in handy (as did the holidays, since the little bugger picked up every bug imaginable in his first few months at the childminder)

Yes - you should be allowed to carry forward a maximum of 28 days (I think - statutory minimum) - similar to how you can carryforward hols accrued during sick leave

Bump too - my employer (public quango) say I can only carry over 5 days leave?

this answers my question, i actually started my maternty leave on the 4th april 2011 and will return to work on the 2nd april 2012, does this mean i am entitled to either have my holiday in year 2012/2013 as well as holiday for this year or get paid instead?

jay7 · 05/03/2012 23:21

it states in my contract that holiday cannot be carried over, as im not due to go back until the 2nd april should i ask to be paid now until then as if i were on holday, i currently dont get maternity pay as this stopped 8 weeks ago :( so this would be very handy :)

I have now asked my HR and they will let me carry over 5 days, I can either get the rest paid out or finish mat leave early and take the holiday (pretty much comes to the same thing). I may therefore get it paid out and then ask for my unpaid parental leave.
