My dp has been sent home from work after a row with his boss. Dp doesn't get any breaks at work even though he works 8 hour days. The row was about the fact that my dp had one smoke break which he saved to say goodbye to me as I was going away for a few days. Dps boss told me to get lost but by swearing and sent my partner home. Is the boss out of order when i was there for one minute and dp doesn't get breaks. Advice would be much appreciated.

By law he has to have a break if he works more the 4 hours in a row. His boss is breaking the law. What environment does he work in? Is there a health and safety reason why you shouldn't be able to pop up to see him for 5 minutes on his break?

Actually it is 6 hours, not 4, but the company is still breaking the law. Your DP is entitled to an uninterrupted break of 20 minutes which must not be at the start or end of the working day.

They do not have to allow you onto the premises during his break or at any other time. Do they have any rules about access?

He works in a shop and I wasn't in the shop at all I was outside with my dp.

Oh wonder where I got 4 hours from? Ah well, 6 then! I am sure he can't stop you from standing outside the shop, if its a public street?

Yeah public street. Was only outside for a few mins.
