hi there, wondering if anyone has experience or knows about paying back SMP. i'm due to go back to work at beginning of feb, although i still havent had any discussion with my work about this?? .. i am thinking i will probably hand in my notice as i want to look after my baby full time but i'm worried they will say i'll have to pay back my smp. does anyone know what my rights are and if i do have to pay it back can it be in small amounts?

You don't have to pay back SMP at all. If your employer paid you anything over and above, they may have rules about having to pay it back, which should have been notified to you beforehand. But SMP is yours to keep. :)

well if you have taken your full year you should have loads of annual leave to take as well? Thats counts as time back, in my works you have to go back for 3 months or repay any enhanced benefits (over the SMP)
