SSP Question - complicated situation!

My brother works in a large commercial kitchen - he is off sick as he had a fall and broke his hand, he is not yet fully fit and is still having physio for tendon damage. His gp has said he can have a phased return to work so far his employer will not let him back on helth and safetly grounds (he can't lift heavy pans etc). He is getting ssp from employer.

He has been offered a temp job in a small restaurant(which he is able to do as there is no heavy lifting) - he intends to do this through the books, paying tax etc until his main employer allow him to return.

My question is this - can he claim ssp and work for the second employer?

As long as they are not part of the same business he can claim SSP from one while working for the other.

I wouldn't let this situation run on for too long though as HMRC might question the SSP payments after a while.
