Will i have to repay enhanced maternity?

Hi,

I am due to return to work at the end of Nov, with about 20 days annual leave to take. I took the AML on the basis that I would return to work for at least the necessary 12 weeks to avoid repaying.

I have now found out that I am pregnant again, due mid Feb.

So my question is; is it still classed as returning to work for twelve weeks if I go back on maternity leave within said twelve weeks? I hope that makes sense...

It would make a big difference if I did have to repay and would have to consider going back earlier if needs be.

I am reluctant to clarify with work as I don't want to alert them to my pregnancy just yet. They were a nightmare during my last pregnancy, so would like to avoid as much as poss!!

I think you won't have to pay back the money for this pregnancy as you will go back for 3 months. However, you may only be entitled to statutory for the next pregnancy (where I work you have to go back for a year to be entitled to enhanced again). With your holiday it should be about 12 weeks that you are back.

Sorry I am not sure now after seeing you don't think you will be back for 12 weeks, why not contact CAB?

I think as you will still be employed you won't have to pay it back!

Simple answer is you'll have to ask work. Yes you're employed but employers can attach what ever conditions to AML leave that they like so they can say that the 12 weeks is 12 weeks in the office not 12 weeks being employed.

So you'll have to ask them.
