Advertising question

If a job becomes vacant, does it legally have to be advertised or can it just be 'given' to someone with no advertising of any description? I'm just curious as am having a mini argument with a friend about this!

No legal requirement to advertise, no, although for lots of reasons it's not a great idea to just give vacancies to individuals with no effort at a transparent process.

Many companies, particularly larger ones, have a policy of advertising at least internally, which is very sensible, but there's nothing legal to state a vacancy must be advertised.

Doesn't have to be advertised - can be given to whoever the management decide.

Some placesmight have rules that it must be advertised etc but in law no it doesn't have to be.
