Boss asking me to up hours on my return from ML? Help.

Before I went on ML with no 2, I worked 3 days a week. My boss has now told me that he will allow me to return to 3 days a week for 13 weeks but then he wants me full time. Is there anything that I can do to allow me to continue 3 days. Thanks so much in advance for any advice. Am really down about this.

how many hours does your contract state?

bamboostalks · 10/03/2011 15:55

My contract is a very old one and it states permanent and fulltime so my part time position has been an ad hoc one.

How long have you been on 3 days a week? If it's long enough then your contract may have changed by "custom and practice" e.g. it has been custom and practice for you to work a 3 day week so that is your contractual terms. This would depend on what your contract actually says and how your part time work was treated. It might be worth seeking advice from an expert in employment law.

Thanks for that advice. I started 3 days in January 2009.

Did you ever get a letter saying that your hours/pay/holiday/car allowance/bonus (delete as appropriate!) changed due to going to 3 days p.w?

I don't think this is much help at all but where I work at the moment there is a massive re-structure going on and all PT people have been told they have to go FT or take redundancy so presumably companies can legitimately do this ( or maybe not and they're banking on people not challenging them?!). Not sure if there is an added complication because of the fact you've been on mat leave.

It is illegal to discrimate against someone for working part time in redunancy proceedures.

No letters received at all. There are no redundancies underway either. I am in a senior position and I think he really wants me back.
