Sick / Holiday? Deductions OK?

Posted this on legal too, but desperate for advice before dh goes off, sorry.

Hiya

Would like some info please, before dh pops off to work at 7.15 so he is armed and ready, as they (psychopaths? film directors? who knows) say

Dh had four days off work sick last month. he works a four on / four off shift pattern. On the last day he telephoned to say that he was now available for work, and spoke to his Line Manager. That was all OK. he had the four dyas off he was scheduled to take (he's have gone in if asked to cover, but wasn't) then had three days BOOKED and OKAYED holiday, booked way before.

Went to check pay slip, he was deducted £400. Apparently, because he had holiday that counts as a ten day stretch, even though he notified them.

They said it was OK for them to do this. It leaves us with £120 for the rest of the month, work petrol alone costs that, even before food etc.

How do we stand legally?

re-bumping this as everyone from Dh's HR dept is on holiday and we're not getting any advice (CAB open Monday)

Not sure i fully understand the situation but if what you are saying is that your dh was fit to return to work after four days and that the only reason he did not go to work was that he had booked and agreed holidays, then he should only have the four days when he was incapacitated for work count as sickness absence and the remainder as normal holidays. I suspect that there has been a lack of communication between your dh's boss and the person who does payroll. Print of a page of the months calender, mark in his working shifts, non-working shifts, the booked holidays and days of absence due to sickness and get your dh to sit down with his boss and whoever does payroll and explain what happened when!

I work for local government and they are really hot on sick days off,I have to have a back to work interview if I take one day sick!!Anyway,i agree with Sis,your partner contacted notified them accordingly,stick to your guns,he had 4 days sick full stop-I wonder what would of happened if the 4 sick days were on days off!!!Good Luck,do look in the small print of job description/contract.That
should clarify matters
