Sick Pay

Hiya,
I've had a fall and broken my left wrist and have had an operation (apols if typing is a bit dodgy). Hospital have signed me off for 6 weeks. Work (I work part-time)have said that as i've already had 2 days off sick in the last 6 months they will not pay me sick pay, despite my contract not mentioning anything about this new rule. Finding it really hard to get any feedback from HR, plus I have the added stress of my 3 year old twins to sort out (husband does his best).
Surely they can't do this?? Any advice would be gratefully received as I cannot survive for 6 weeks on just SSP.

What does your contract say about sick pay? Is there an employee handbook or similar? If so, what does that say about sick pay?

Whether or not your employer has to pay you anything depends on what it says in your contract. You have no absolute right to sick pay other than SSP, I'm afraid. However, if your contract says you are entitled to sick pay they have to pay it in line with the terms of your contract.

Agree with prh but if you're saying this goes against your contract then you will need to raise a grievance for unlawful deductions from wages.

On a practical note, if it turns out that you're not entitled to contractual sick pay then you could take some of it as holiday. I know that's far from ideal but at least it would bump your pay up a bit.

I'd recommend getting in touch with HR asap and finding out what your options are - just keep bugging them and preferably by email so that you have a record of their failure to get back to you.
