Any experts on Redundancy Modification Order & continuous service?

I'm in the public sector (local government) and am facing redundancy. My service with my current employer started in 2002, and with my previous employer in 1995. There was no gap in service between the two jobs - I left the old job on a Friday and started the new one the following Monday. As far as I'm aware, both organisations are covered by the redundancy modification order so my redundancy pay should be backdated to 1995.

However, HR are saying this does not apply because I left my previous employer voluntarily. My understanding was that public sector employees can move around without loss of service if employers are covered by the RMO.

My union is looking into this for me but is snowed under dealing with other members being made redundant and I was wondering if anyone on here had experience of this situation? The redundancy pay isn't great and it would make all the difference to have those extra years included.

Hi im in the public sector too. It sounds like you certianly have continuous service so your redundnacy should be caluculated on the 2 periods of employment. its easy to get a copy of the modification order, google it, i think i got one from the LGA site, check your previous employer is on the list and if they are your current one should not have a leg to stand on> i've worked in the public sector for over 20 years and moved jobs voluntarily and its counted as continuous service for redundancy payment calculations. sound like they are trying to pull a fast one. Hope you get it sorted :)

Thanks so much Curly - I think I was feeling a bit overwhelmed and powerless, and you've made me feel better. Will let you know outcome.

If you're still around Curly, HR finally acknowledged my continuous service and have agreed to backdate my redundancy payment.

Glad to hear that, as I would have encouraged you to "fight fight fight fight for this right" as Cherly Cole might say.
