Handing in my notice - some quick advice please!

I am supposed to be returning from maternity leave on the 17th of this month. I dont want to go back because of a number of reasons.

Anyway, my normal maternity leave ended on Sunday just gone (2nd/3rd). These next two weeks im off are annual leave i booked to "tag on" to the end of maternity to use it up.

(Otherwise i would have had 18 days to use up between now and Christmas).

I have already written back in September to say i was going to return after my maternity leave but is it okay to hand in my notice whilst on annual leave? I only have to give 1 weeks notice.

(I have already accrued this annual leave so i wouldnt be taking more time than i was due and they would, in fact, still owe me 4 days if i handed in my notice as of Friday).

HELP!

To my mind it is fine - you are officially back at work now, so can give notice when you want.

Of course you can - if you hadn't been on maternity and were on 'normal' holiday - you could hand your notice in. Make sure you get your unpaid holiday pay too.

I would say so - annual leave is still classed as work to me. Your maternity leave has finished, had you not booked holiday, then you would be at work now. Your employer won't have your return date as 17th, but 3rd with x amount annual leave.
