Will I owe them money?

I am due to return to work ina couple of weeks(am currently on a/l following end of my maternity leave). Had arranged to return part time. However, was called into work recently and told that redundancies were necessary and my job was one at risk.

I have proposed voluntary redundancy.

This is being considered but I have 2 queries...

  1. my redundancy package has been calcualted based on nmy new part time salary, depsite my accrued 10 years sevice being full time. Is this right?

2)If I take voluntary redundancy will I have to pay back the optional maternity payments, as I won't be returning for the obligatory 13 weeks?

If you are not returning to work at all then your redundancy should be based on your pre maty leave salary. But if you are part time when you are made redundant then it will be based on the part time salary.

I don't think you'd have to pay back your OMP - it's not your choice not to return

Thanks. I think that's where it's going to be blurred. I guess as I am now on annual leave I am technically on my new part time conditions (although I haven't signed a contract).

I am trying to avoid returning as I don't see the point in going back just to leave a short while afterwards.

Just want to be sure I get what I am entitled to.
