I've resigned from work - financial question

Hi everybody

Just wondered if any of you out there had some gen on my situation. I've handed in my notice to my part-time job and have given one month's notice until the end of August. I'll obviously get paid for the hours I've worked and have been told that any overtime I do will be paid the following month which is fine. I have 14 days holiday a year (and the holiday year commenced from 1st April) but haven't taken any holiday at all. By the time I leave in August, I will obviously have worked for 5 months of the year without taking any holiday. Does anybody know whether I'm entitled to be paid for this or is it a case of I haven't taken it and its tough? My line manager is less than helpful, but I just wondered if anybody knew anything about this?

By the way, I work for the NHS.

how come you only get 14 days holiday a year, that doesn't seem very much?

either you can take it as holiday or take it off your notice period (ie stop working now) and get paid for it that way. They can't stop you taking it AND insist on your notice period.

Thanks aloha, I didn't realise I could insist on that. I suppose I could also tag it on at the end of my notice period? Is there some kind of employment law stating this? Even though its the NHS, the payroll/personnel dept are useless and I haven't been given any information about what I'm entitled to. I figured that it might be a case of if I haven't taken it whilst there, I lose it.

metired - I only work part time so my holiday is pro rata (full time employees get 28 days).

Unless you are in a job which is not covered by the working-time directive, then you should be paid for any accrued leave not taken. If you are exempt from the directive (eg by being a junior doctor), then I'm not sure of the position - it may depend on what is written in your contract. See here for the basics.

They may well adjust your holidays to account for the fact that you've only workd 5/12ths of the year so you'd get 5/12 x 14 = 6ish Certainly when I worked this was how it was done until you past a certain point in the holiday year I think.

metired, I assume it's because susanb works part time - if you work 3 full days a week, then 3 days holiday is equivalent to a week.

If you leave part way through the holiday year, you are entitled to be paid for unused holidays - assuming, as Miriamw said, that you are not in one of the few occupations exempted from the Working Time regulations. Also, as everyone is entitled to four weeks paid holidays, I assume the 14 days is the equivalent of four weeks for your part-time hours.

Sorry, I don't think I made it very clear you would only be paid for hols earned over the five months in the current holiday year that you had worked for the company.

Yes, sis, I see what you mean. I would get the equivalent of 5 months holiday ie, 14 days divide by 12 months times 5!
