Hi, I was hoping you could help me.

My OH has been suspended for a while now for apparant abusive conduct which he did not do. There is so much to do with this case which my OH has put in writing as a form of grievance against two managers.

It is the same two managers who are conducting his investigation. His complaint also refers to the investigation itself and the way it is being conducted.

Can you tell me what happens with regards to his hearing. Can he demand that these managers are not allowed to conduct it.

He has proof that they are trying to compile a case against him as they know the current complaint will not be enough to discipline him. He has put this in his letter.

He can't demand who conducts a disciplinary hearing, no. If he has concerns about the managers involved he should do as he has done and make those known in a grievance. If his employer wants whatever disciplinary action they are contemplating to stand up, they would be wise to take his concerns into consideration and if appropriate, identify alternative management to conduct the hearing.

If they ignore his concerns and go ahead with the hearing being conducted by the two managers in question, he can then appeal any warning he is given and outline his concerns in the appeal, highlighting the fact that he raised them promptly in order to give his employer the opportunity to address them.

Thank you so much for your advice. We have sent that off now and waiting to hear back. They still have not been in contact after 3 weeks. It really isn't a serious matter at all so I'm shocked it s taking so long.

Whenever he calls they pretend to be in a meeting, he is not allowed to talk to anyone else.
