Won't go back to work, advice needed!

Hi everyone, this is my first time on mums net, as I need advice. My maternity leave will finish in end of February 2011 and I will need to go back to work. But I started new business few months ago and it is going really well, so I decided not to go back to work. Would I be entitled to take 28 days pay holiday for April 2010-march 2011from my current employer? If so, when to ask my employer? And when to hand my notice? Am scared if I hand my notice too early they will not pay for my holiday. Also I have to add that I already received all my maternity pay (39wks) as my work policy is to pay for maternity leave all in once.

You might be able to be paid for the holiday but for the days that you accrue only. So if you resign now for example you will only have accrued so many days. Be careful about working when you are receiving SMP. You aren't allowed to do more than 10 keeping in touch days with your employer. Not sure how this applies to starting your own business though. Well done on the new venture though!

Hi, I'm not sure but if you don't go back to your original job will you not have to pay back your maternity pay?

thank you for advice, but now am getting even more confused on what to do. I thought, that i hand my notice in January 2011 or tell my employer that I want to stay longer at home with my little one...?
