Thank God this would not be legal in the UK. A rape victim of 15 years old written to by a defence attorney about her use of pronouns when a witness in the court where her attacker was convicted and sentenced.

It's reported in a reputable German newspaper here, sorry behind a paywall, but putting it up to show it's genuine.

That is utterly horrific.

I saw this yesterday. Total “that never happens” writ large. Just fucking awful.

In his sentencing remarks, Judge Andreas Bartschmid oddly declared that despite his rape of a child and extremely large collection of child pornography, Schmid was “not a pedophile.” His gender transition was “not a fetish,” Bartschmid added, but simply “rotted in an inner inclination within the defendant.” He also said that his teenage victim had suffered “no long lasting effects” from the attack at the motorway service station, only physical pain during it.

Now there's a judge who's in the wrong job.

To give this man three years in prison for raping a 15 year old is absolutely disgraceful.

Raped at 15, no long lasting effects? The women of Germany must be feeling very afraid right now.

So much about this story makes me furious, not least that the compensation for being violently raped and suffering years of trauma is about the same as being inadvertently called "he". 😡

SharkyBait · Yesterday 16:36

I am so angry at this. I wish severe harm on all those men who have let that poor girl down, and I am beyond furious at every man and woman who is on the side of this utter insanity.

I wish even more harm on the women who supported them, they couldn't have got to this point without them.

I can't express the level of disgust I feel that a 15 year old girl raped by a man with a library of paedophilia should be forced to apologise for "misgendering" the man who raped her.

How come the German authorities can't see how outrageous this is?

I’ve bookmarked this thread to share any time some nitwit comments that coercing people to use wrong sex pronouns isn’t harmful.

A report from BR24 Bavaria said that Schmid was “subjected to particular hardship due to sometimes defamatory media coverage and her placement in the men’s section of Munich Prison.”

Cry me a river! Unbelievable.

Is Germany one of those countries that have been repeatedly held up to us as being good for women's rights?

Any of our usual suspects going to chime in on this one with their steaming hot take, or can we expect tumbleweeds?

solerolover · Yesterday 21:02

I read the reduxx article the other day and my blood was boiling. Everything about this situation is hellish.

The degree of rage this gives me is off the scale

i swear, all child rapists should just be feet first into a wood chipper

how bloody dare the defence lawyer issue a cease and desist?

and as for the judge deciding she’d not come to any psychological harm, words bloody fail me

Concerns about a EU influence would be why I’d reluctantly change from being an ardent Remainer to a Brexiteer.

I'm certainly a lot less an ardent Remainer than I was! But maybe it depends partly on how much the EU want us (a topic that's never discussed by the Remain enthusiasts). I used to think, not much, but I'm changing my view on that a bit now. Terf Island would not put up with the situation in Germany and elsewhere. And Andy Burnham is not stupid; he must know that too. Would the EU make it a sticking point? Maybe not.

That poor child. 3 years is an entirely inadequate sentence. I am also full of rage about this. Reminds me of the dude in Australia who abused his 3 year old daughter, sharing his abuse with an online dude in the USA, and got a light sentence because of his gender confusion, and then went to the women's estate... still there.
Judges seem to be a massive part of the problem globally don't you think?
It's mostly men but also I read of female judges, particularly in the family court in the US (I'm kind of following a grass-roots movement to stop violent and abusive men from getting custody, which happens a lot over there), who consistently prioritise men in legal proceedings.
What to do?
These things make me feel so helpless, i want to quit my job and stand outside Parliament House or something, or in a city street corner with a sign.
I want to organise a global womens strike.
Or a global coup-de-tat, and lock up every single person who has ever done or supported or excused any violence against women and children.
Guess I'll just write another letter to my MP.

Same here. The judge even mentioned the physical pain the man inflicted on her, only to dismiss it. He shouldn’t be allowed in a courtroom.

Same. I voted remain but for a few reasons not looking for re-join. This is one of them.

Awful to see op.

I want to know why that judge doesn't understand that vaginal penetration is not the same as being stabbed with a knife elsewhere in your body. That's not something you would ever expect to have happen again, though of course you would fear it. But why he doesn't understand that girl will want to experience sex with a person she likes and that every future occasion she does that will be tainted with the memory of this. How can that ever be dismissed in the way he did? How can he not KNOW that?
