Thanks for the reminder.
"Her legal claim is discrimination on the grounds of her employer’s perception that she had gender critical beliefs and on the grounds of her protected belief in evidence-based medicine. The respondent defends the latter claim by pleading that evidence-based medicine is just an opinion, not cogent or coherent and not relevant to a weighty or substantial aspect of human life and behaviour; does not meet the Grainger Criteria."

Evidence-based medicine is supposed to be a 'belief' now, and a Health Service is saying that evidence-based medicine is just an 'opinion', is that just legalese or am I missing something.

nauticant · 14/10/2026 12:35

It's not even legalese, it's pretendy nonsense. When it was challenged in the ET the CEO respondent dropped this ridiculous defence.

Boadicea2 · 14/10/2026 12:39

Let's continue here as there are replies already but I'll paste @Boadicea2 's helpful text:

From TT:
Dr Redvers (claimant/C), named GP safeguarding lead, is bringing a constructive dismissal case against NHS Sussex Integrated Care Board (respondent/R1) and its then CEO. Concerns were raised about the practice of a specific doctor at WellBN, a Brighton GP practice.
She claims that as a result of escalating those claims from 2020 onwards she was constructively dismissed. She claims discrimination on the grounds of her employer’s perception of her gender critical beliefs and on the grounds of her protected belief in evidence-based medicine.
NHS Sussex subsequently launched an investigation. The findings identified serious failings in WellBN’s assessment, consent, safeguarding, prescribing and monitoring processes, with potential harm reported in cases reviewed.

This doesn't usually happen!

Boadicea2 · 14/10/2026 12:41

Do it to Elizabeth.

He's getting tearful.

He honestly did NOT see this tribunal was going to be so brutal about his part in this whole mess did he?

CriticalCondition · 14/10/2026 12:46

He sounded on the verge of tears to me with all the bilge about how difficult being a CEO was. Pure self pity.

From TT

CM statement was drafted or approved by you? From Scene magazine?
AD Yes
CM This statement was drafted or approved by you
AD No drafted. I wld receive many of these, checked by the comms team. I wld have to get all Chief execs and the LAs to approve joint issues
CM This relates to eradicating t'phobia. What prompted this release?
AD I cant say
CM [sound gone] [reads re becoming a trans ally etc]
AD Yes
CM U cant identify the prompt for this
AD I've answered this. I was often asked to make statements of relevance. Maybe an event. I wld often make BH month in Oct. To demonstrate inclusiveness etc. It happens a lot in my role
CM A mag that DSH writes in?
AD We often write articles about lots of diff topics eg racism. You can see in hte bundle
CM p938: Miss Cambridge perculates the statement to many incl the C.
AD Yes, not me
CM I'm going to suggest that by this stage y'd received Cx of TP. And proj image of being opposed to this
AD I dont accept that
CM p? Email to DSH re 3 July and concerns re SG team and appointing an Ix. I will share the terms of ref with you in due course. Very conversational speech? AD Yes
CM Was this just for audience of DSH
AD I have many approaches to how I deal w ppl. It's v pressurised work. U want to motivate ppl so I try to keep emails Light - it's my style. If more formal or serious u write in a more formal pattern. There's a time for both
CM p950: the GMC closed Ix on 15 July. U wld not have committed that statement w/out knowing about the GMC or y'd have been a hostage to fortune if serious issues had been found
AD What are u getting at?
CM Shared statement w TCP, directed by DSH. U wldnt be such a vocal ally unless u knew no issues w the GMC
AD I was asked to do an incl statement but I had no information about the GMC. I wasnt confident to get all the LAs and Ch execs w strong opinions - that seems odd to me
CM when did u get info from GMC about the C
AD Not sure

AD I dont know him
CM Did u share the report w the 2 orgs I cant recall. It cld have been Elizabeth. I'm not sure - maybe NHSE received a copy
CM Eliz and MP had quite a lot of contact.
AD I dont know how it left the org.
CM Following DSH asking for help, yr email of 9 July provided that protection from GMC at large? U and NHSE work together at various stages to spike the GMC proceeding s
AD Absol not and point me to the evidence that shows that
CM We only got this info last Monday
J I'm struggling to see yr point. This is an email u say provides covered
CM The GMC closed Ix on 15 July..
J How and when was this shared w GMC
CM We dont know. It's coincidence. Within 6 days the GMC close their proceedings

Boiledbeetle · 14/10/2026 12:51

AD finding a bit of fight in him now he knows lunch is imminent.

One trick is get the witness to believe that a break is coming very soon then whip that away with them realising that the grilling will continue. It's good for demoralising witnesses.
