Tempest (a TW) is claiming discrimination, harassment and/or victimisation on grounds of gender reassignment. Central to the claim is the existence of the Sex Equality and Equity Network in the Civil Service (SEEN). SEEN has been granted right to intervene. Parts of the original claim against the co-chair of SEEN (Elspeth Duemmer-Wrigley) and another party (Andreas Mueller) were struck out or narrowed. Another claimant, PQ, is no longer part of the case.

Please note that Elspeth still has a garden in need of seeds and water to support the ability of SEEN to be an intervenor in this case. The claim originated because she said "only women menstruate" and a search with her name and those terms at the usual gardening website should point you to her plot.

Interesting that the judge is pursuing his own enquiries into the internal guidance

You judge can say whatever you want. Nothing has stopped you so far.

From TT:

NC so it would be completely unlawful to say that one network could put out posts and exist, and the other could not
NB I agree
NC particularly so as SEEN's understanding of sex is what we now is correct, consistent with FWS,
NB I agree
J email in Nov 22, 2 1/2 years before FWS

NC I said 'we now know was right all along'
J yes
NC NB you were asked lots qs about whether there was an equality impact statement before DEFRA SEEN being allowed on Yammer
NB yes
NC isn't the short answer to all this qs, that you don't do an equality impact assessment

MarieDeGournay · Yesterday 12:19

Yessss!🙂

At least you would get Jam. 😁

I have very fond memories of strawberry picking as a child. Hope you have fun.

Is that you Malcolm?
Actually I'm just imagining Malcolm Tucker taking part in this shambles and actually made myself laugh out loud so I had to stop. But wouldn't it be just brilliant.

Yes, that would be marvellous! Just don't let wee Jamie near it, the psycho fucker.

Come the fuck in or fuck the fuck off. The best response ever for a door-hoverer and I so wish I could use it in a work context.

From TT:

before deciding not to break the law
NB I agree
[discussion of microphone]
NC there was never any possible q of equality impact assessment, you had to do what you had to do under the law
NB yes
NC you were asked about same for allowing DEFRA SEEN to exist, and its the same you can't break the law and directly discriminate to avoid other groups being upset
NB I agree
NC if you had men in the workplace....
J I think the point is made....
NC we've seen this before guidance about how to set up an employee network and what they are for

Shortshriftandlethal · Yesterday 12:21

J " One on each side" if I can say that....

What an inane comment. He's taking this impartiality business too far.

Blackberry picking for me, on the railway embankments. Then my mum would make loads of jam.

Happy memories.

Later in the year there is a very fine Mirabelle plum tree that gets raided. We are a house of jam fans.

Mention the word men and the judge is in there like a rat up a drainpipe

Having worked within a Defra arms length body at the time, I am actually really glad that this is all out in the public domain. An unintended consequence of the case.

I was pretty new to the organisation and was horrified to see how hostile the reaction to the launch of SEEN was. I had never worked anywhere where there was not a general level of respect to other staff members. It soon became obvious to me the damage that staff networks had caused to the organisation which is a shame as some provided useful information such as being more inclusive to deaf and hard of hearing staff during online meetings.

The leadership were cowards in letting the activism get out of hand. Including unscientific information being unchallenged in online posts, which quite frankly were embarrassing for an organisation that was built on science. I didn't join SEEN immediately, as I thought the staff networks were on balance bad for the organisation. Also due to fears about being doxxed if my identity was discovered, which was a reasonable fear based on what has been discovered during this tribunal. Ultimately I did join to show solidarity to colleagues and show that there was opposition to the GI orthodoxy within the organisation.

I hold the civil service responsible for many of the crazy policies that we have seen in society on this issue. It is very out of touch with the average person in the UK.

Btw, have left now, thank goodness!

Edited

Really interesting to read how all this was affecting normal people, who just wanted to work. Thank you.

DrSpartacularsMagnificentOctopus · Yesterday 12:23

The judge is strongly bringing to mind something that bewilderness used to frequently quote:

"Meet me in the middle" said the unjust man
You take two steps forward
He takes two steps back
"Meet me in the middle" said the unjust man

FarriersGirl · Yesterday 12:24

From TT:

says 'employee networks have incredible potential to shape the culture in their orgs' thats true but not always in a good way
NB that's true

NC staff networks agender, LGBT, etc have brought about the culture of DEFRA supporting GI, realised their incredible potential to shape the culture
NB don't know if i can answer that, our culture is to respect the cs code and impartiality, they've had a strong impact across the org, but it's the code that determines impartiality and inclusion.
NC that's how it should be but I suggest that's not how it is

my note: BOOM go for it Naomi!

CriticalCondition · Yesterday 12:24

The judge has a regional accent. C's counsel has a regional accent. C has a regional accent. AL does not but he doesn't sound 'clipped'. He has a deep male voice softened by a bit of vocal fry. It would be no surprise to me if the judge is irritated by NC's clear, crisp, confident tones and RP delivery. Uppity woman from Down South derailing his tribunal.

"NC paras 76-78; fair paraphrase that it treats objecting to use of SS facilities as suspect, suggests they should go elsewhere
NB yes"

Would 'elsewhere' include the desk of whoever authored this policy? 🤬
