Guidance makes trans people a third sex

There seems to be outrage this morning that the guidance is making trans people a third sex.

I am puzzled. We are frequently lectured that sex is really complicated and people who don't have more than a GCSE understanding of it shouldn't comment. We are told it's not binary because people don't fit nearly into those categories.

So why all the outrage about third spaces? 🤔 Won't they be great for non binary people and all the gender fluid people who say they are male one day and female the next?

It is indeed a conundrum.

Almost as though they need to continue to find something to complain about, because... snot fair... they don't want us to exist...snot fair... <stamps foot> because...because.... reasons.

Meadowfinch · 22/05/2026 10:27

It is the logical conclusion though. If a person born male has chosen to transition, and is adamant that they are not male, and biologically they certainly aren't female, then they must be a third sex.

They sound like spoilt children yelling 'I want you to tell me I am female and I'm going to scream and stamp until you agree with me".

In future all buildings should have three loos, male, female and other. Then everyone is safe and there is no confusion.

RhannionKPSS · 22/05/2026 10:28

It’s interesting and amusing, that they, Jo Mo for one , are admitting there are only two sexes

MrsOvertonsWindow · 22/05/2026 10:30

It's the consequence of society finally saying NO to a group that's been able to trample all over the rights of others. Massive toddler tantrums.

SecretSquid · 22/05/2026 10:31

It's almost as if the only system that would give them the dignity and safety they deserve* is one which necessitates bio males having access to female spaces. Unless I missed something?

Nope. They thought they could do this and women wouldn't notice. They also think we are stupid and they are very clever.

ArabellaScott · 22/05/2026 10:45

We've had 'sex isn't binary' for years now.

Are we going to see an enby schism?

I am 100% certain that if women had never pushed back, and these men had been allowed everything they wanted, eventually that would have become not enough. We would still have had the tantrums at some point down the line.

This whole thing, at its heart, has been an experiment in the power of I Want.

Nothing will ever be enough because some men will never be happy and will never grow up. And of course it's all women's fault.

The third space is a reasonable compromise - though it is massively inconvenient for people with physical disabilities who aren’t trans (since it seems at times the trans/invisible disability Venn diagram is actually a circle it’s not going to make any difference to a proportion of people who were already using the accessible facilities)

I have already seen two cafes in my local area change their toilets to mixed sex because they can't offer a third space. This will probably happen a lot more in certain areas so in some ways, the guidance has shot itself in the foot.

This is the logical consequence of TRA demands now the courts have acknowledged that women are actual human beings with rights. Women are entitled to single sex spaces. Trans people don’t wanna go in their own single sex spaces. Therefore we need universal spaces.

Realistically TiFs have been doing this for some time because the sensible ones don’t feel comfortable in the gents. It’s just the menz with hurty feels to deal with now.

Well if they offer the facilities with enclosed sink and drying facilities then it shouldn’t be a problem. Maybe a bit of extra cleaning. On the plus side it means that the inevitable queue for the ladies is reduced as there are now 2 options. I think most people are used to small organisations having to cater in the best way they can. My hairdresser and dentist only have one toilet because of space and people just accept it. Bigger organisations not so much especially where there are lines of cubicles and no single use loos.

JuliaMaesa · 22/05/2026 12:36

As a wise pathologist once observed:

Corpses only ever come in two sexes .... now grow up.

I think this is the issue. On the one hand, they need to cater to trans individuals because of the guidance, but they only have regular toilet blocks. So they have chosen instead to just say all facilities are mixed. I gather from some local TRAs this is what a lot of places will now start doing and be happy to be taken to court.

Justme56 · 22/05/2026 13:10

I think everything depends on context and ability to provide in the best way they can. I do have sympathy for small organisations as this should have been settled many years ago. However as service providers they will also have employees so will be governed by health and safety legislation too. So whatever decisions they make they will have to consider what are the best options.

One of my local cafes has changed its two loos to (1) women and (2) mixed sex which I think is the best solution actually.

If TRAs kick off about third spaces they will lose a lot of sympathy from some people who’ve broadly supported them. Never mind, eh? <gets tiny violin>
